1. Acceptance of these terms

These Terms of Service govern your use of https://emilyn.me and of the emilyn Studio Services social media management services provided by emilyn (“we”, “us”). By using the website or our services, you agree to these terms. If you use our services on behalf of a company, you confirm you are authorized to bind that company.

2. Our services

emilyn publishes editorial content on this website. Through emilyn Studio Services, we also manage Facebook Pages and Instagram professional accounts for studios and creators, including content publishing, comment management and performance reporting. The specific scope, fees and deliverables for each client are set out in a separate agreement, which prevails over these terms where they conflict.

3. Account authorization and client responsibilities

If you authorize us to manage a Facebook Page or Instagram account, you confirm that:

• You own the account or are authorized by its owner to grant us access.
• You own or have the rights to all content you ask us to publish, and that content does not infringe anyone’s rights or violate any law.
• You will comply with Meta’s Terms of Service, Community Standards and Commercial Terms, as well as Instagram’s Terms of Use.

You may revoke our access at any time through Meta Business Manager, Facebook or Instagram settings. Revoking access ends our ability to perform services on that account.

4. Content ownership

Clients keep all rights to the content they provide and to the accounts we manage. You grant us a limited license to use, format and publish that content solely to provide our services to you.

All other content on https://emilyn.me, including articles, design and logos, belongs to emilyn or its licensors and may not be copied or republished without permission, except as allowed by law.

5. Acceptable use

You may not use our website or services to break the law, infringe intellectual property, distribute spam or malware, scrape or overload our systems, or violate the policies of Meta or any other platform.

6. Third-party platforms

Our services rely on Facebook, Instagram and other third-party platforms. We are not responsible for their availability, policies or changes to their APIs. emilyn is not affiliated with, endorsed by or sponsored by Meta Platforms, Inc.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy at https://emilyn.me/privacy.

8. Disclaimers

The website and services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular reach, engagement or business result.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the website or services is limited to the fees you paid us in the 12 months before the claim, or USD 100 if you have paid nothing.

10. Termination

We may suspend or end your access to our website or services if you breach these terms. Clients may end services as set out in their agreement. Sections 4, 8, 9 and 11 survive termination.

11. Governing law

These terms are governed by the laws of the jurisdiction in which the operator is established, without regard to its conflict-of-law rules. Disputes will be resolved in the courts located there, unless the law of your country of residence requires otherwise.

12. Changes

We may update these terms. The new version takes effect when posted on this page; continued use of the website or services means you accept it.
